David Caldwell

Notes for David Caldwell: Land Grant #404; Caldwell, David; 200 acres; Roane County3 Jan 1809. 1:404 and 1:452. The last will and testament of David Caldwell Deceased which was returned to court at March session 1844 was received by the court and ordered to be recorded and is as follows to wit. I David Caldwell of the County of Rhea state of Tennesse being of sound mind and dispossing memory do make order and publish this my last will and testament in the words and figures following viz. 1st I will and direct that my body be decently entered and that my Funeral Expences be paid out of my Estate. 2nd I will and direct that sll my Just debts be paid out of my Estate. 3rd I will and bequeath to my Elizabeth Caldwell absolutely and in fee simple my negro man Stepney my negro woman Ginny and my young Gray mare. 4th I will and bequeath to my wife Elizabeth my negroes Manervia Samuel and Bob and Malinda during her naural life or widowhood the hapening of eaither of said Events terminates this Estate in my wife Elizabeth and the above named negroes viz, Menervia Samuel Bob and Malinda shall be equally divided between my children Jacob C. Caldwell William A. Caldwell Jonathan Caldwell and Dudly Caldwell provided However nothing in th foregoing shall be construed as to prevent my wife Elizabeth from giving to each or all of my affroesaid children their share of said negroes whenever she may think proper. 5th I will and bequeath to my wife Elizabeht th eplantation on which I now live together with all my stock constiting of horses hosgs cattle and sheep my waggon and team farming utensials during her natural life widowhood the happenting of eaithe of said events terminates this Estate in my wife Elizabeth when I will direct that the above described property shall be equally divided between my children Jacob C. Caldwell William A. Caldwell Jonathan M. Caldwell and Audley Caldwell nevertheless my Executors shall be and are hereby epowered to sell and dispose of the said tract of Land containing two hundred and forty acres more of less so soon as the same can be done on reasonable term and the proceeds diveded as above directed after reserving and sufficiency to pay specified Legacies herein bequeathed and for the support of my wife Elizabeth and her family indirectly all her household whe vested in a suitable manner. 6th I will and direct that my executors pay my son Alexander Caldwell the sume of two hundred Dollars out of my Estate when my Land shall be sold as above directed. 7th I will and bequeath to my duaghter Margaret Ann Mayo the sum of two Hundred Dollars to pe paid her out of my Esate when my Land shall be sold as above directed. 8th I will and direct that my Executors pay to my Daughter Nancy Derise Rachael E. Lea and son Robert W. Caldwell David P. Caldwell and John M. Caldwell the sum of Five Dollars each out of my Este when my Land shall be desposed of as above directed. 9th I will bequeath to my daughter Mary Elizabeth Caldwell my gero girl Mariah and one horse sadle and Bridle worth on hundred and twenty Dollars when she marries or arives at the age ot twenty one years. 10th I will and bequath to my wife Elizabeth all my household and litchen Furniture reserving a reasonable portion at the option to her option to be given to my Daughter Mary Elizabeth Caldwell when she marries or arives at the age of twenty one years. 11th I do herby nominate constitute and appoint my sons Jacob C. Caldwell and William A. Caldwell my executor to this my last will and Testament hereby revoking all others. In testamony whereof I have hereunto assigned my name and affixed my seal this the 10th day of December in the year of our Lord one thousand Eight hundred and thirty nine and of American Independence the 13th . Signed sealed & published in presence of Jacob H. Love Mary E. Love David Caldwell From which foregoing Statement it appears that the said Adimistrator is chargable with the sume of $946.70 for assets which came to his hands to be administeded and of which sum said Administrator in the due course of his Adminitration desbursed in the payment of claims against Daid Estate the sum of $139.45 which leaves in his hands the sum of $807.25 and it further appears that there are twelve Destributies of Said Estate, to wit, Robert W. Caldwell, John M. Caldwell the heirs of James A. Caldwell Decd. Jacob K. Caldwell, Margaret A. Mayo, Rachell Hammel, The heirs of Mary E. Moleston, D.P. Caldwell, Nancy Defrece, the hirs of William A. Caldwell, Johnathan Caldwell and A.P. Elizabeth Kelly

Notes for Elizabeth Kelly: From an article about Jonathan M. Caldwell by Godspeed, we are told that the marriage of David Caldwell and Elizabeth Kelly produced chidlren. We do not know how many or which ones. A letter from J.A. Caldwell (son of Jonathan M. Caldwell) to Panelope Allen, J.A. Caldwell says he believes Rachel is a half-sister to his father. It is possiable Racheal is the daughter of Elizabeth Kelly. Of the other children, I suspect James Alexander is also a child of Elizabeth Kelly. Elizabeth Kelly's father's name was Alexander Kelly, I believe James Alexander was named for him.

08 May 1794- Knoxville Gazette: Notable Marriage in Hawkins County Mr. David Caldwell to Miss Elizabeth Kelley, daughter of Col. Alexander Kelley of Knox Co. Elizabeth was omitted as a child of Alexander Kelly in the following article. She was his daughter as the marriage annoucement show. Alexander KELLY was born about 1750 in Armagh County, North Ireland, and was brought to America in infancy. His place of residence during the Rev. War was at Greenbriar, VA. He served as a private in Capt. Thomas PARRAMORE's company, 9th VA Regiment, commanded by Col. Thomas FLEMINGS and later by Col. George MATTHEWS. He enlisted July 9, 1776, and was taken prisoner Oct. 4, 1777, at Germantown. The records show that on Nov. 21, 1785, he received from Col. CROPPER a certificate for the balance of his pay amounting to twenty-three pounds and four shillings. After the war Alexander KELLY moved to the TN country and served as Lieutenant coloner of Knox County Regiment, Hamilton District Militia, Territory of the United States South of the River Ohio, which is now Tennessee. His name appears on the muster roll for Aug. 27, 1794. Kelly became prominent both in business and political affairs. Acknowledgment of his business acumen is the fact the Knox County Court of June 16, 1792, ordered roads to be laid out from Knoxville to his mill and to David CRAIG's, which was on the Nine Mile Creek. In April 1783 the General Assembly of NC divided Washington County the second time and formed Greene Country; Alexander KELLY was appointed assessor for the Third District. Knox County sent KELLY as a delegate to the Territorial Legislature on Aug 25, 1794. The first legislature of TN met March 28, 1796, and was represented by eleven counties; KELLY served as the senator from Blount County. He was re-elected Sept. 18, 1797. Alexander KELLY was one of the first to enter land on the TN River in Marion County-in 1824; his parcel amounted to almost 3,000 acres. Unfortunately, soon after coming to the Sequatchie Valley, he drowned in the Sequatchie River. He had six children: John, who married Nancy MAYO; Alexander, Jr., who married Sally PRIGMORE; William who married Ruth PRIGMORE; Viny, who married Adam LAMB; Annie, who married Richard W. STONE; and Margaret, who married Joe PRIGMORE. Alexander KELLY, Jr., and Sally PRIGMORE were married on Feb. 17, 1817. They were the ancestors of W.J. LEWIS, Dr. PRICE, and Bob KELLY of Sequatchie County. William KELLY (the third son) and Ruth PRIGMORE were married Jan, 7, 1812. They were the ancestors of Mrs. S.H. BENNETT, Mrs. M. HARRIS, and Crit and Will KELLY of Bledsoe County. Viny and Adam LAMB are buried in an old graveyard near Palo Station in Sequatchie County. They were the ancestors of the LAMBS who live in that community. Margaret and Joe PRIGMORE were the ancestors of the PRIGMORES and PRYORS of Marion County. In 1826 John KELLY was granted a charter by the state to build a turnpike road to ROSS's Landing (Chattanooga); at this time he constructed the first bridge across the Sequatchie River. He was the first to advocate the building of a road around the base of Lookout Mountain, following the route that is used by the N.C.&St.L. Railroad. He and his son-in-law, Ignatius HALL, also had a government contract to remove obstructions, from the TN River. In politics, John KELLY was a Whig. He was a member of the Constitutional Convention of 1834, served as a circuit court clerk, and held other public offices. He helped to organize the Olive Branch Lodge F.&A.M. at Jasper. He was a member of the Cumberland Presbyterian Church; his wife was a methodist. They were the parents of 13 children, some of whom are mention in the following paragraphs. Easter KELLY married Ignatius HALL Jan 6, 1820. She died on Jan 12, 1888. They had nine children, the youngest of who, Thomas P. HALL died on May 5, 1931, aged ninety yrs and 8 months. A daughter, Polly, lived to be ninety-three years and 5 months. Alexander KELLY married Elizabeth OATS, daughter of Col David and Sarah GRIFFITH OATS. Alexander was a farmer by occupation. He also kept the KELLY's Ferry and had a store at different times. He owned 25 slaves before the war. In the Ebenezer Cumberland Presbyterian Church he served as a ruling elder. His death occured about the year 1878. Adeline married Daniel RAWLINGS. She died on Ap 15, 1831. They were the grandparents of Mrs. Maggie GODDIER. Thomas KELLY married a FOSTER; he died Nov 1, 1885. Martha KELLY married James HOGE. She died Nov 28, 1834. They were the grandparents of Julia HOPKINS. Not much is known of the other children. Valentine went west. "Served as second major, Greene County militia, and as justice of the peace for same county under the State of Franklin; commissioned lieutenant colonel, Knox County militia, 1792; lieutenant colonel commandant, Blount County, 1795; represented Knox County in the territorial assembly; one of the commissioners to lay out Maryville" DAR Records - Membership Roster and Soldiers 1894-1960 DAR Tennessee, Vol. 1 Page 952 -- ALEXANDER KELLY - born 1755, Ireland, Armagh county, died after 1838, Tennessee. Married 1778, Nancy Robinson. Served as a private in Captain Thomas Parramore's company of the 9th Bat., and as Captain in Greenbriar Militia. (Adj. John KELLY, Alexander's oldest son, was born June 2, 1779. On April 8, 1798, in Monroe County he married a woman of Scotch-Irish descent named Nancy MAYO, a native of NC, born in 1777.
